Alabama Regulatory Updates 06/07/2023
HB 497 – Relating to Workers’ Compensation; to Amend Section 25-5-11, Code of Alabama 1975, to Further Provide For the Employer’s Right of Subrogation Against Uninsured and Underinsured Motorist Insurance; and to Specify That In a Settlement of Claims Against a Third Party, the Employer’s Share of the Employee’s Attorney Fees Does Not Include Costs or Expenses.

Summary:
This measure credits awards to an injured employer against an employer’s uninsured or underinsured motorist coverage to the workers’ compensation liability of the employer, up to full liability coverage in the case of an award in excess of the liability. It takes effect the first day of the third month following enactment.

Summary:
This measure creates Alabama code to provide for co-payment assistance and/or disability payments for law enforcement officers and firefighters who receive treatment for PTSD. This measure applies to law enforcement officers and firefighters employed by a municipality, county, or fire district.
This measure provides that such an employee diagnosed with post-traumatic stress disorder would be reimbursed for certain co-payments for treatment or would require a county or municipality to maintain sufficient coverage for the reimbursement of co-payments.
This measure would also require counties, municipalities, and fire districts to provide disability payments or coverage for law enforcement officers and firefighters who are unable to return to work as a result of PTSD.
This measure will take effect on January 1, 2022.

Summary:
The measure includes PTSD under the definition of occupational disease under workers’ compensation benefits paid to an emergency responder.
The measure stipulates the disorder to have happened in the time of employment without regard to accompanying physical injury.
The measure will go into effect the first day of the third month after enactment.
