HB 153 – Worker’s Compensation Competitive Coverage.

Issues: Worker’s Compensation (General)

Summary:

This measure caps the workers’ compensation premium rates at the bottom 1/3 of average state rates nationally. If this would not be actuarially sound, it caps it at the average national rate for no more than two years out of the effective range. It is effective January 1, 2024 until December 31, 2028.

Most Recent Update:

1/20/2023 This measure has been scheduled for hearing on January 20 in the Minerals, Business, and Economic Development Committee, chaired by Representative Michael Greear (R). The meeting will be held in person in Cheyenne and remotely with a live video stream available on the Legislature’s Website, www.wyoleg.gov. A limited number of participants can sign up to provide public comment virtually for a specified agenda item during the Committee’s upcoming meeting. The total amount of time dedicated to virtual public comment is set by the Committee Chairmen per Management Council Policy. Please fill out the public comment form to ensure the Committee knows you intend to provide public comment virtually. Only those who fill out the form to provide public comments virtually and who are e-mailed the Zoom invite from the Legislative Service Office will be permitted into the Zoom meeting to testify.

SF 117 – An Act relating to first responder workplace mental injury coverage

Issues: Workers’ Compensation (Medical Coverage And Reimbursement)

Summary:

This measure provides for workers’ compensation coverage of mental disorders in first responders.

The measure stipulates that “injury,” as defined under Wyoming Statutes 27-14-102, shall include a mental injury if such injury is experienced by a first responder and established by clear and convincing evidence, which shall include a diagnosis by a licensed psychiatrist or licensed clinical psychologist meeting criteria established in the most recent edition of the diagnostic and statistical manual of mental disorders published by the American Psychiatric Association.

The mental injury shall only be deemed a compensable injury if the first responder, as a condition of employment, submitted to a psychological examination administered by a psychiatrist or psychologist licensed in the state of Wyoming who ruled out the presence of the same mental injury from any preemployment exposure.

If the employer does not provide an examination as a condition of employment, the mental injury shall not be compensable under this subdivision. The mental injury shall not be considered a compensable injury if the mental injury is directly attributed to disciplinary action, work evaluation, job transfer, layoff, demotion, termination or similar action taken by an employer.

Most Recent Update: On May 26, this measure became law without the Governor’s signature. The provisions of this measure shall take effect on July 1, 2020.
