Summary For 01/27/2025

This measure provides that if an employee or their dependent receives workers’ compensation from another state, they can still file a claim for the same injury or death. However, the amount awarded by this state will be reduced by the compensation already received from the other state.

  • This rule applies to all claims pending as of the effective date of the Parity in Workers’ Compensation Recovery Emergency Amendment Act of 2022 and to claims filed after that date.

This act will take effect after the Mayor approves it (or if the Council overrides a veto by the Mayor) and after a 30-day congressional review period.

B 512 – Parity In Workers’ Compensation Recovery Temporary Amendment Act of 2023

Summary:

This measure allows workers’ compensation awards in D.C. even when awards were granted in another state, provided that the award amount is reduced by the amount granted in that other state.  It takes effect following mayoral approval and congressional review and lasts for 225 days.
